Using Xpress Link LLC means agreeing to a working relationship built on security, reliable delivery, and mutual respect. These are the rules of the road.

Agreement to Terms

A binding agreement begins at account creation.

These Terms of Service govern access to and use of Xpress Link LLC's secure messaging platform. By creating an account, accepting an order, or allowing a User to access the Service, the Customer accepts this messaging platform terms agreement.

"Service" means the hosted messaging tools, administration controls, APIs, support, and related documentation provided by Xpress Link LLC. "Customer" means the person or organisation that opens the account. "User" means anyone authorised by the Customer to use it.

The Customer must have authority to accept these terms. Keep your account details accurate.

02 / Use with care

Acceptable Use Policy

The platform is for lawful communication. Every account owner is responsible for the messages sent through it.

    Follow applicable federal, state, and local rules, including privacy duties under HIPAA and GLBA when those laws apply to your work.

    02. Protect people

    Do not send threats, abusive content, malicious code, or material that creates a foreseeable risk of harm. Consent matters.

    03. No abuse

    No spamming, phishing, credential theft, unauthorised access, security testing without written approval, or attempts to disrupt another account.

We may review account activity when needed to investigate abuse, meet a legal duty, or protect the Service. We may restrict access while an investigation is open.

Service Commitments

Measured service. Clear ownership.

Area Our commitment Your responsibility
Availability We target 99.9% monthly uptime for the core Service, excluding planned maintenance and events outside reasonable control. Keep authorised credentials private and maintain a working internet connection and supported client environment.
Support We acknowledge standard support requests within one business day and handle service-impacting reports according to severity. Give us account identifiers, timestamps, affected Users, and useful diagnostic detail so we can act.
Continuity We maintain backup and disaster recovery procedures designed to restore platform operations after a qualifying incident. Keep your own retention copy where your legal or operational policy requires one.

The 99.9% target is a service commitment, not a promise that every message will arrive instantly or that every third-party network will remain available.

04 / Your information

Data Ownership and Confidentiality

Your customer data stays yours. We handle it to provide, secure, and support the Service.

The Customer keeps rights to message content, contact records, and files submitted through the platform.

We don't mine customer content or share it for advertising. We disclose information only as described in our agreement, privacy notices, or legal process.

Available encryption key management options depend on the plan. If the Customer controls keys, losing them may make data unreadable.

The Customer controls User permissions, device access, and account security. Tell us promptly about suspected compromise.

05 / Legal boundaries

Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", SUBJECT TO THE EXPRESS SERVICE LEVEL COMMITMENTS ABOVE. Xpress Link LLC DOES NOT PROMISE THAT THE SERVICE WILL MEET EVERY BUSINESS REQUIREMENT, OPERATE WITHOUT INTERRUPTION, OR DELIVER EVERY MESSAGE OVER NETWORKS WE DO NOT CONTROL.

TO THE EXTENT PERMITTED BY LAW, Xpress Link LLC'S TOTAL LIABILITY ARISING FROM THE SERVICE IS LIMITED TO THE FEES PAID BY THE CUSTOMER FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THIS LIMIT DOES NOT REMOVE LIABILITY THAT THE LAW CANNOT LIMIT.

The Customer will protect and reimburse Xpress Link LLC for claims arising from unauthorised use, unlawful content, or a breach of these terms caused by the Customer or its Users.

06 / Closing an account

Termination and Suspension

Access can end when the agreement ends or when safety requires immediate action.

A

Termination. Either party may end the agreement according to the applicable order or subscription terms. Unpaid fees and material breaches can end access after notice where notice is legally required.

Suspension. We may suspend an account for serious security risk, unlawful use, or conduct that threatens the Service or another customer. We will restore access when the reason is resolved.

C

Data exit. The Customer should request an export before termination. After the applicable retention period, we may remove customer data from active systems and backups.

D

Survival. Confidentiality, payment duties, intellectual property protections, disclaimers, liability limits, and indemnification continue after access ends.
